TERMS & CONDITIONS / STUDENT LEARNING AGREEMENT

It is important, before you purchase one of our course or support options, that you have a clear understanding of your purchase and enrolment rights, what you can expect from us and what your responsibilities are. This is to make sure that there are no misunderstandings between us.

Once you have agreed to the following terms and conditions, the agreement below will be legally binding.

This Student Learning Agreement / Terms & Conditions applies to the use of the Website and purchase of any Online Course or Support. Please read these Terms and Conditions carefully before purchasing an Online Course and print off a copy for your records. linguisttraining.com will not file or otherwise keep a copy of any agreement concluded between you and linguisttraining.com, and a copy of the concluded agreement will not be available from linguisttraining.com at a future time and date. By registering on the Website and / or elearning platform, you are confirming your agreement to be bound by these terms and conditions.

STUDENT LEARNING AGREEMENT incl. TERMS OF PURCHASE

Applicable when payment is made for enrolment. By making an order on the website or in any other manner, you confirm that you have read and accept these terms.

  1. linguisttraining.com will provide you with suitable course materials, sufficient for your course, as detailed in the course information on our website.

  2. linguisttraining.com will provide past exam papers and / or similar, as part of your fee, if they are required for the option on which you have enrolled.

  3. linguisttraining.com will inform you when, and how, to enter CIOLQ exams upon request.

  4. Our course fees do not include any CIOLQ registration fees or exam fees. These and any other charges they may make, are payable directly to the CIOLQ.

  5. Course material and lessons / modules are available for a period of 12 months from date of purchase / enrolment unless otherwise stated.

  6. linguisttraining.com will update your learning materials as and when necessary. This constant updating process means that if course structures change after you have enrolled - new subjects may be added, out-of-date subjects removed, and course content / translation assignments may differ.

  7. Changes that relate to courses using CIOLQ exams are made in line with CIOLQ handbooks. We will also provide you with updates, if necessary, when you enter the CIOLQ exams, as part of our exam training service.

  8. linguisttraining.com will encourage you during your studies.

  9. linguisttraining.com will provide you with access to appropriate expertise to support you during your course, if included in the course / support curriculum.

  10. If video sessions have been ordered, a LanguagePartner will be assigned for practice on past exam papers.

  11. linguisttraining.com will return Translation Practice submissions to you with feedback from a professional linguist as per your chosen Translation Practice, within 7 working days where possible.

  12. linguisttraining.com will deal with any difficulties promptly and fairly.

  13. linguisttraining.com operates an equal opportunities policy.

  14. linguisttraining.com will reinstate you on the course, subject to our written agreement, if you have been removed for any reason, provided any outstanding course option/s fees are brought up to date. However, if you have not communicated with us for more than 6 months, we will ask you to re-enrol and will charge you up to 30% of the original course fee.

  15. linguisttraining.com will allow you to transfer to another more suitable course, if possible and subject to our written agreement. A transfer fee will be charged. This will be in proportion to the amount of the original course you have completed. In other cases, you may re-join the course at any time if your course option/s fees are brought up to date and on payment of a £50 administration fee.

  16. We will not be able to proofread your Translation Practice, offer video sessions with your LanguagePartner or provide online course materials if your course option/s fee instalments are not paid up to date.

  17. linguisttraining.com will offer training, advice and support to prepare you for your CIOLQ exams (if you are doing a course that includes CIOLQ exams).

  18. Proof-reading and feedback by our LanguagePartners: our LanguagePartners will always provide the highest quality work however, please note that none of their opinions or scores are ratified by the CIOLQ. They do not and cannot constitute a guarantee of passing the exam. We have no control over the results or decisions made by the marking team of the examining board and cannot guarantee your passing of the exam in any way.

  19. linguisttraining.com will not be held responsible, or liable, for problems or financial losses that are caused by circumstances outside our control - for example, exam board acts or decisions, overseas examination offices, the CIOLQ.

  20. linguisttraining.com will remove you from the course if, in our opinion, your behaviour towards us, or any member of our staff, is abusive or unreasonable; or if you indulge in plagiarism by submitting work for Translation Practice marking that is not your own, breach our copyright notice. Refunds will not be made in such circumstances.

  21. linguisttraining.com will charge a fee of £75 for any cancellation of a scheduled video session, if made with less than 24 hours notice. Payment will be required from you before a re-scheduled session can be made.

  22. linguisttraining.com aims to reply to all enquiries within approx. 24 working hours, during standard working hours and not including Bank Holiday and company holiday times.

  23. linguisttraining.com, using Zoom or any other virtual meeting facility, will record LanguagePartner meetings, sessions, Mock Exams etc. These recordings are saved on the platform’s and occasionally our, internal servers. Random quality checks are made by linguisttraining.com staff. Any content on these recorded sessions is not made public without your permission.

COPYRIGHT NOTICE

  1. Lessons / modules content, instructions, lesson / module plans for all online courses, support and any other interpreting and/or translation courses and course options etc. created, published and hosted by Linguist Training Ltd t/a linguisttraining.com on any web pages or platform may not be reproduced, copied, shared with others without permission. Copyright exists in all other original material published by the CIOLQ or students of Linguist Training Ltd t/a linguisttraining.com and may belong to Linguist Training Ltd t/a linguisttraining.com depending on the circumstances of use.

  2. linguisttraining.com will maintain security of our website to the best of our ability including updating and / or changing access codes on a regular basis. Please note, we may not always be in a position to pre-warn you of such a change meaning that when you encounter this, you will have to contact us to obtain the latest access codes.

YOU AGREE TO: 

  1. Be the only person that carries out the studies on the course you are enrolled on – you must not share the content or your account access details with anyone else.

  2. Read the relevant course information pages on the linguisttraining.com website to establish that the course is appropriate for you. You may email us or telephone us (see contact page) if you wish to discuss your course options.

  3. Read the course structure file thoroughly at the start of the course so that you are fully aware how the course works.

  4. Respect the importance of noise-free study around the face-to-face live video sessions with your LanguagePartner. Mobile phones must be switched off in sessions.

  5. Proceed with the course in the way prescribed in the course structure file. We may not be able to support you fully, or at all, if you decide to proceed with the course in a different way. This especially applies to courses leading to CIOLQ exams.

  6. Ensure that all course option/s fees are paid by the agreed times.

  7. Undertake sufficient private study to maintain progress on your course. This will involve doing your own research to supplement our teaching materials.

  8. Submit work which is your own original work, clearly presented and a true reflection of your knowledge and abilities. Students who commit plagiarism by submitting work that is not theirs will be removed from their course immediately, without refund of fees.

  9. It is your responsibility to meet deadlines; submit any translation practices, etc.

  10. Submit work in the correct format (usually Microsoft Word), and by the method explained in the course structure file.

  11. Keep in contact with us by emailing the first instance to ask for help if you are stuck.

  12. Take reasonable precautions against computer viruses if communicating with us online.

  13. Register with any external awarding body if we ask you to do so.

  14. Understand that, every year, a decision regarding where CIOLQ oral exams can be taken, is subject to there being sufficient candidates in each language pathway and is made solely by the CIOLQ.  It is not in the control of Linguist Training Ltd t/a linguisttraining.com.  The decision will be published a number of weeks prior to the exam dates.

  15. Accept our refund policy: as detailed below.

  16. Make a fee payment of £75 for any cancellation of a scheduled video session, if made with less than 24 hours notice. Payment will be required before a re-scheduled session can be made.

  17. Make arrangements for the video session to be scheduled as detailed above.

  18. Not share your personal or contact information with anyone other than linguisttraining.com staff. This includes LanguagePartners - i.e., do not share your phone number or email address with your LanguagePartner. This is because your agreement / contract is with us, not any third parties and only Linguist Training Ltd is registered with the Information Commissioners Office (ICO) to process such information according to the GDPR and Data Protection Act. linguisttraining.com cannot be held responsible for any such shared information.

  19. Comply with our copyright notice as detailed above.

REFUNDS

Following The Consumer Contracts (Information, Cancellation And Additional Charges) Regulations 2013, under Section 2(3), a ‘consumer’ is defined as “an individual acting for purposes that are wholly or mainly outside that individual’s trade, business craft or profession”. Therefore, linguisttraining.com generously considers the purchaser and / or student as a ‘consumer’ only if they are a private individual seeking training for personal development reasons. Should linguisttraining.com decide that the purchaser and / or student is a commercial entity, trader or business, linguisttraining.com reserves the right to not apply The Consumer Contracts (Information, Cancellation And Additional Charges) Regulations 2013.

As a consumer, you are entitled to the following ‘Right to Cancel’, according to The Consumer Contracts (Information, Cancellation And Additional Charges) Regulations 2013: You (as a consumer) have the right to cancel a course within 14 days. This right applies regardless of whether the course will be taken online or in person. However, this assumes that you have not accessed the course material on the course website. Your right to cancel starts the moment you place the order and ends 14-days after you received the item. If you change your mind within this time frame, you may be entitled to a refund. However, please note that if you access the course material provided by linguisttraining.com (usually, but not solely, hosted on thinkific.com), you waive your right to this 14 day ‘cooling-off’ period / you waive your cancellation rights. Please do not access any course material within the first 14 days of your enrolment if you do not wish to waive this right.

Please consider that The Consumer Rights Act 2015 states that digital content must be:

  • Of satisfactory quality

  • Fit for a particular purpose

  • As described by the seller

Please consider these terms:

“Of satisfactory quality”
linguisttraining.com go to, and have always gone to, great lengths to make sure that the course content is of the highest quality (well above ‘satisfactory’ quality level), and have many, many, unbiased opinions and feedback to support this high level of quality. It is unlikely that any of the courses and / or support that linguisttraining.com offers can be deemed ‘of unsatisfactory quality’ due to vast amounts of independent evidence against this.

“Fit for a particular purpose”
Courses and support provided by linguisttraining.com which are tailored towards taking examinations held by the CIOLQ have produced excellent examination results (Passes, Merits and Distinctions) for many students, therefore it has been proven that these are ‘fit for a particular purpose’.

Courses and support provided by linguisttraining.com which are tailored towards ‘real-life’ professional work are highly rated and feedback tells us are relevant to professional work in the field, therefore it has been proven that these are ‘fit for a particular purpose’.

“As described by the seller”
Course / support descriptions on our website and our elearning platform (usually thinkific.com), are written in an exacting manner, closely following the content of the courses and / or support chosen, therefore it is highly unlikely that the description will not be accurate. Therefore please ensure that you read all course / support information provided on our website / elearning platform (usually thinkific.com) very carefully before you make a purchase, as the reason of ‘not as described by the seller’ is highly unlikely to be accurate.

If you’re unhappy with your digital product, linguisttraining.com has one opportunity to ‘repair or replace the content’. In the case of linguisttraining.com digital products, this would constitute ‘repairing’ the online content or ‘replacing’ the online content. You can choose whether you’d like the item to be ‘repaired’ or ‘replaced’ but linguisttraining.com can refuse if there is proof that if there is nothing to ‘repair’, or your choice isn’t of the same value as the alternative. If it’s not possible to provide you with a repair or replacement or it would be extremely inconvenient or time consuming, you’re entitled to a full or partial refund (following the conditions already mentioned above).

linguisttraining.com offers the additional refund policy:

  • If you are not completely satisfied with the course or support, and you email us within seven days of payment, we will refund your fee, in full, no questions asked.

  • If you have accessed a portion of your content, especially if a large portion, a refund is unlikely to be fair or reasonable as you will have experienced benefit.

  • The seven days start from the date you make payment.

  • As administration charge of £40 will be charged for making a refund.

  • Any refund made, for whatever reason, will be made via the same method as the payment was originally received.

  • This does not affect your statutory rights.
